Matt Barr Receives Defense Verdict
Matt Barr recently received a defense verdict in a jury trial completed in front of Judge Fred Eady in Fulton State Court. Matt represented an Atlanta hospital and an individually-named nurse. The Plaintiff was a patient of the emergency department of the hospital who alleged that the nurse triaged her but improperly failed to admit her to the hospital. The patient delivered a stillborn fetus on the toilet of the waiting room of the hospital. Plaintiff was seeking punitive damages in addition to damages for emotional distress. The jury returned a defense verdict after forty minutes of deliberation.

Edward Slaughter negotiates favorable settlement in wrongful death trial in New Orleans
Ed Slaughter started a wrongful death trial in New Orleans that was was brought by the heirs of a Arleen Pellegal claiming their decedent's mesothelioma was caused by second hand exposure to her husband's work clothes. Decedent's husband was a pipe fitter at Avondale's Harvey Quick Repair Yard. The case was resolved favorably after the court ruled in the defendants favor on several key legal issues. Paige Keith assisted during the trial.

Ronald G. Polly, Jr. and Jonathan M. Hill receive win in Eleventh Circuit Court of Appeals
The Eleventh Circuit Court of Appeals recently affirmed the decision of the U.S. District Court for the Southern District of Florida in a Title VII employment discrimination and retaliation action brought by an employee against his former employer, SSA Security, Inc. Ronald G. Polly, Jr. and Jonathan M. Hill successfully defended the action, which included both federal and state claims. The District Court granted summary judgment in favor of SSA and plaintiff appealed to the Eleventh Circuit on the issues of employer pretext and the admissibility of his "expert" opinion on alleged gun defect, a material issue in the case. The Eleventh Circuit affirmed the lower court's decision, determining that plaintiff had failed to meet his burden in offering specific evidence of employer pretext, and that he was not qualified to give expert testimony. The Eleventh Circuit's ruling in favor of SSA all but forecloses plaintiff's ability to seek the damages he claimed, which exceeded $1 million.

In March 2007, David Marshall obtained a defense verdict for Sunrise Senior Living, Inc. in Gwinnett County, Georgia. Plaintiff sustained personal injuries and alleged both simple negligence and professional negligence. Texas Court Finds Verdict Unaffected by Erroneous Jury Instructions
FORT WORTH, Texas Despite finding that a jury was given improper instructions in an asbestos trial, a Texas appellate court has ultimately determined that the error did not result in improper judgment. Verret, et al. v. American Biltrite, et al., No. 2-04-244-CV (Texas 2nd Dist. Ct. App., Forth Worth).
